Statement of Claims against AOT

Subject: Notification of Statement of Claims against Airports of Thailand Public Company Limited
To: President, The Stock Exchange of Thailand
Airports of Thailand Public Company Limited (AOT) would like to inform of the receipt of a statement of claims from the Thai Arbitration Institute (TAI), the Judiciary of Thailand on November 13, 2009, which has been submitted to the TAI by a joint venture based on the construction contract of Passenger Terminal Building at Suvarnabhumi Airport and the contraction contract of Concourse at Suvarnabhumi Airport. The statement of claims represent the Arbitration Case No. (Black) 103/2009 and the Arbitration Case No. (Black) 104/2009 dated October 30, 2009, which requires the AOT to pay compensation according to those two contracts, totaling 7,070.69 Million Baht and 568.77 Million Yen together with interests, to the joint venture.
On November 20, 2009, the AOT has made an offer to the Office of the Attorney General to appoint a prosecuting attorney as the AOT's representative and an arbitrator representing the AOT in dealing with the arbitration process. The proceedings are now under the consideration of the TAI.
