Re: Notification of Temporary Injunction by Civil Court for Legal Dispute between King Power Duty Free Co., Ltd. and Airports of Thailand Plc.

The Civil Court has issued a temporary injunction on 31st January 2008 for the legal dispute between King Power Duty Free Co., Ltd., the plaintiff and the Airports of Thailand Public Company Limited (AOT), the defendant, detailed as below:
1. AOT shall allow King Power Duty Free Co., Ltd. to continue to operate the duty-free shops at Suvarnabhumi Airport and Regional Airports in accordance with the contract between AOT and King Power Duty Free Co., Ltd. dated 20th April 2004, and the First Amendment of the Memorandum of Agreement, annexed to the Concession of Operating Duty-free Shops at Suvarnabhumi Airport and Regional Airports Ref. No. SA 1-07/2004, dated 20th April 2004, allowing King Power Duty Free Co., Ltd. to operate duty-free shops only in the space it has occupied before the issue of the temporary injunction, by Civil Court.
2. King Power Duty Free Co., Ltd. shall implement the construction and decoration of shops as in Item 1 in compliance with the law and international safety standards, that is, causing no harm to passengers and other airport users at Suvarnabhumi Airport. However, King Power Duty Free Co., Ltd. shall be essentially given consent from AOT who will consider this matter with fairness and expedition.
3. King Power Duty Free Co., Ltd. shall pay compensation to AOT as required in the concession. Should the Court rule the concession as non-binding, this shall be considered as compensation for damages incurred to AOT.
This temporary injunction by Civil Court shall remain valid from now until it is otherwise amended or rescinded under court ruling.
